§ 3. Work conditions.

  • (Pursuant to R.S. 33:404 et seq., the day-to-day operation of the police department is determined by the chief of police. A separate policy/procedure document promulgated by the chief of police sets out the "work conditions" for that department.)

    A.

    (1)

    Each municipal area should be staffed from 8:00 a.m. to 5:00 p.m. on Monday through Friday and such other times as directed or approved by the mayor and the council.

    (2)

    Work week.

    (a)

    The regular work week for full-time employees is intended to be 40 hours from Monday through Friday, except as otherwise determined and approved by the mayor and the council.

    (b)

    The work week runs from Saturday through Friday for payroll, accounting, leave, and overtime purposes.

    (3)

    Work day.

    (a)

    The regular work day for full-time employees shall be set, in writing, by the mayor and employees shall be notified of same.

    (4)

    If it is necessary for employees to work beyond the regular work day, the mayor or authorized department head may authorize or require overtime work.

    (5)

    Compensatory leave.

    (a)

    (1)

    Municipal employees, other than police personnel, will normally perform their work during hours established by the mayor.

    (2)

    Police personnel will normally perform their work during hours established by the chief of police.

    (b)

    (1)

    If it shall prove necessary for employees, other than police personnel, to work beyond the hours established for the standard workday, the mayor or authorized department head may authorize or require overtime work.

    (2)

    If it shall prove necessary for police personnel to work beyond the hours established for the standard workday, the chief of police may authorize or require overtime work.

    (c)

    An "overtime hour" is an hour worked by an employee, other than police personnel, at the direction of the mayor or authorized department head and is an hour worked by a police personnel at the direction of the chief of police:

    (1)

    On the employee's official holiday.

    (2)

    In excess of the regular duty hours in a regularly scheduled workday.

    (3)

    In excess of the regular duty hours in a regularly scheduled workweek.

    (4)

    On a day which the employee's department is closed by direction of the mayor because of a natural emergency.

    (d)

    Compensation for overtime and for work required on an observed holiday shall be as follows:

    (1)

    Compensatory leave earned at time and one-half rate or cash payment at time and one-half rate, at the employee's option. However, any such employee who accrues 30 hours of compensatory leave shall, for any additional overtime hours of work, be paid overtime compensation at time and one-half rate. All accrued compensatory leave must be used by the end of each calendar year, unless approved by the mayor (or police chief for police personnel).

    (2)

    For police personnel and other full-time employees of the municipality—cash payment at time and one-half rate.

    (e)

    (1)

    Holidays observed by the council shall not be counted as annual leave. Employees not scheduled to work on an observed holiday and full time appointed department heads will receive full pay for such days. No more than 12 days shall be so designated by the council within a calendar year.

    (2)

    No employee is eligible for compensation on any observed holiday when the employee is on leave without pay immediately preceding and following the holiday period.

    (f)

    Notwithstanding any other provision of this chapter, no overtime shall be considered, nor compensatory leave or overtime pay given, for work performed by any elected municipal official or full-time department head.

    B.

    Holidays.

    (1)

    Municipal holidays shall include the following days and any other day determined by the mayor and council:

    New Years Day.

    Martin Luther King Day.

    Mardi Gras.

    Good Friday.

    Memorial Day.

    Independence Day.

    Labor Day.

    Veterans Day.

    Thanksgiving Day.

    Acadian Day (Day after Thanksgiving).

    Christmas Day.

    Employee Birthday.

    (2)

    Working on a holiday at the direction or with the approval of the mayor or the appropriate department head is a condition of employment.

    (3)

    (a)

    Any holiday observed by the municipality which occurs during an employee's regular work hours shall be considered as a work day during that week for purposes of calculating the work week.

    (b)

    If a holiday falls on a Saturday, the holiday will be taken on Friday. If a holiday falls on a Sunday, the holiday will be taken on Monday.

    (c)

    If a holiday otherwise occurs on an employee's regular day off, the employee may take the day before or the day after the holiday or accept a later date in the calendar year.

    (d)

    When the provision of city services requires it, certain employees may be required to substitute holiday leave time for leave on other days so that city needs can be met on holidays, while allowing all employees the benefit of paid holiday leave. (For example, when a holiday falls on a Friday, some employees may be required to take the holiday leave on the following Monday to allow for adequate staffing on the regular holiday.)

    (4)

    Holidays shall not be counted as annual leave. Employees will receive full pay for such days.

    (5)

    No employee is eligible for compensation on any holiday when the employee is on leave without pay immediately preceding and following the holiday.

    C.

    Employees are not required to come to work or to remain at work during any time when they are released from work by the mayor due to an emergency or bad weather conditions. Employees will be compensated as if they were working, except that any employee who elects to work during normal working hours shall not receive extra compensation.

    D.

    Pay period. Salaried employees shall be compensated on a semi-monthly basis. Employees compensated on an hourly basis shall be paid weekly. (See addendum 2 for additional detail on pay period.)

    E.

    Time accounting.

    (1)

    Time clocks or time sheets shall be provided for the recording of employee time.

    (2)

    Each employee must personally account for his own time. Any employee who asks anyone else to sign or log the employee in or out or who attempts to sign or log in or out anyone other than himself may be dismissed or otherwise disciplined.

    (3)

    Any employee who falsifies a time card or sheet may be dismissed or otherwise disciplined.
