§ 66-151. Hardship variances.

  • Where the tract to be subdivided is of such unusual size or shape or is surrounded by such development or unusual conditions that the planning commission finds that extraordinary difficulty or injustice would result from strict compliance with the regulations in this chapter, it may vary the regulations so that substantial justice may be done and the public interest secured, provided that such variation will not have the effect of nullifying the intent and purpose of the comprehensive planning or this chapter.
