§ 74-39. Horses prohibited on rights-of-way at certain times.

  • The use of horses upon the public rights-of-way within the corporate limits of the City of Carencro, for any purpose whatsoever, during the nighttime hours between dusk and dawn, shall be strictly prohibited. In addition, the use of horses upon the public rights of way within the corporate limits of the City of Carencro during times when visibility is limited by fog,

    rain, dust, smoke or as a result of any other condition, whether of natural or man-made causes, such that visibility is limited to 100 feet or less, is strictly prohibited.

    In addition, the use of horses upon private property directly adjacent to the public rights-of-way within the corporate limits of the City of Carencro by anyone other than the owner of such private property, or the person or entity exercising custody and control over such private property, without the express consent of the owner of such private property, or the person or entity exercising custody and control over such private property, is strictly prohibited.

    Anyone found in violation of the provisions of this section shall be subject to a fine of $100.00 for the first offense, $200.00 for the second offense and $500.00 for the third or any subsequent offense, plus an administrative fee of $50.00. In addition to the fines and fees provided herein, all persons found in violation of the provisions of this ordinance shall be subject to having the animal used to commit the offense impounded by Lafayette Animal Control until such time as all fines and fees are paid to the City of Carencro and all fees are paid to Lafayette Animal Control by the offender or his representative. Upon payment of such fines and fees, the animal will be released by Lafayette Animal Control to the person who provides proof, to the releasing agency, of both ownership of said animal and full payment of all fines and fees due the City of Carencro and Lafayette Animal Control.
